SCENEALLY – LIABILITY RELEASE & ASSUMPTION OF RISK

This Liability Release & Assumption of Risk Statement (“Agreement”) applies to all Users of SceneAlly.com (“SceneAlly,” “the Platform,” “we,” “our,” or “us”). By accessing, using, or participating in any activity connected to the Platform—including browsing listings, communicating with Users, visiting properties, allowing others onto your property, or engaging in any creative or business activity—you acknowledge, understand, and fully agree to the terms of this Agreement.
IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST STOP USING THE PLATFORM IMMEDIATELY.
1. Voluntary Participation
Your access to and use of SceneAlly is entirely voluntary. By using the Platform, you acknowledge that you choose to participate in interactions with other Users of your own free will and that SceneAlly has no involvement in these interactions. You understand that all decisions regarding communication, meetings, bookings, property access, payments, and creative activities occur solely between Users and that SceneAlly plays no role in arranging, supervising, or overseeing any aspect of those interactions.
2. Assumption of All Risks
By using the Platform, you knowingly and voluntarily assume complete responsibility for all risks and potential harms associated with interacting with other Users or participating in any activity related to SceneAlly. These risks include, without limitation:
personal injury, physical harm, or death;
property damage, theft, or vandalism;
fraud, scams, or financial loss;
unlawful conduct or criminal activity by other Users;
exposure to hazardous, unsafe, or unpermitted locations;
misrepresentations or inaccurate listing information;
privacy breaches or unwanted contact;
venue, scheduling, or booking disputes;
emotional distress, conflict, or harassment;
any dangers inherent in permitting strangers onto your property or entering someone else’s property.
You acknowledge that these risks are inherent, unpredictable, and unavoidable in off-platform interactions with unknown individuals—and you accept full responsibility for them.
3. No Duty of Care by SceneAlly
SceneAlly does not evaluate, inspect, screen, verify, or monitor Users, properties, listings, communications, or activities. We do not guarantee that interactions are safe, lawful, reliable, or free from harm. We do not supervise meetings or creative activities and do not mediate disputes.
You acknowledge that SceneAlly owes no duty of care to you and has no responsibility to protect, warn, or safeguard you from any harm that may arise from using the Platform or interacting with other Users.
4. Release of Liability
To the fullest extent permitted by applicable law, you hereby fully and forever release, discharge, and hold harmless SceneAlly and its owners, members, officers, employees, agents, affiliates, contractors, successors, and assigns from all claims, liabilities, demands, causes of action, damages, losses, expenses, or injuries of any kind—whether known or unknown, anticipated or unanticipated—arising out of or in any way connected to:
your use of the Platform;
your communication with Users;
your presence at any property listed on the Platform;
others’ presence at your property;
any creative, professional, or business activity related to a listing;
and any actions, omissions, or conduct of other Users or third parties.
This release applies regardless of whether the claim is based on negligence, strict liability, premises liability, contract, tort, statutory protection, or any other legal or equitable theory.
5. Indemnification Obligations
You agree to indemnify, defend, and hold harmless SceneAlly from any claims or damages brought by third parties as a result of your actions, your Listings, your communications, your conduct, or your use of a property. You accept full responsibility for defending such claims and for paying all resulting damages, legal fees, and costs incurred by SceneAlly.
6. No Warranties or Guarantees
SceneAlly makes no warranties—express or implied—regarding the safety, legality, quality, accuracy, or suitability of any property, User, or interaction. No information or guidance provided by SceneAlly creates any obligation, warranty, or promise of safety or reliability.
7. Medical and Emergency Responsibility
SceneAlly has no responsibility for providing medical assistance, emergency services, safety support, or dispute intervention. You are solely responsible for your own well-being and emergency planning when interacting with Users or participating in activities related to any listing.
8. Binding Effect
This Agreement is intended to be as inclusive as permitted by law and applies to:
all Users;
all activities connected to SceneAlly;
all interactions between Users;
and all claims that may arise now or in the future.
If any portion of this Agreement is held invalid, the remainder shall continue in full legal force and effect.
9. Acknowledgment and Consent
By accessing or using the Platform, you acknowledge that you have read, understood, and voluntarily agree to the terms of this Liability Release & Assumption of Risk. You confirm that:
You accept all risks associated with using the Platform;
You release SceneAlly from all liability;
You are giving up substantial legal rights willingly and intentionally.
and you agree that your continued use of the Platform constitutes ongoing acceptance of these terms.
