SCENEALLY – DMCA COPYRIGHT POLICY

SceneAlly respects the intellectual property rights of others and expects its Users to do the same. In accordance with the Digital Millennium Copyright Act (“DMCA”), SceneAlly will respond to valid notices of alleged copyright infringement that comply with the DMCA requirements. This DMCA Policy explains how copyright owners may notify us of infringing content and how SceneAlly may respond to such notices.

SceneAlly is a listing and communication platform. Users are responsible for the content they upload, including photographs, descriptions, and any other material included in their listings or messages. SceneAlly does not monitor User Content and has no obligation to screen or review material before publication. However, SceneAlly may remove or disable access to allegedly infringing material when it receives a proper DMCA notice, or when it determines, at its own discretion, that such removal is appropriate.

1. Filing a Copyright Infringement Notice

If you believe that content appearing on SceneAlly infringes your copyright, you may send a written notice to our Designated DMCA Agent. Your notice must provide sufficient detail for SceneAlly to identify and evaluate the material in question. For a complaint to be valid under the DMCA, your notice must include all of the following information:

  1. A physical or electronic signature of the copyright owner or the person authorized to act on behalf of the owner.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works are involved, a representative list of those works.
  3. Identification of the material that is claimed to be infringing, along with enough information for SceneAlly to locate it on the Platform.
  4. Your contact information, including your full name, address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.

Notices that do not meet these requirements may be rejected or returned for clarification.

2. SceneAlly’s Response to DMCA Notices

Upon receiving a valid DMCA notice, SceneAlly may remove or disable access to the allegedly infringing material. SceneAlly may also notify the User who posted the material that a notice has been received. SceneAlly is not required to notify a User before removing the content, and removal may occur without prior warning.

SceneAlly may, at its discretion, terminate the accounts of Users who are found to be repeat copyright infringers or who repeatedly submit infringing material.

SceneAlly is not required to adjudicate disputes between Users regarding ownership of content and does not act as an arbitrator. Its role is limited to complying with the DMCA by responding to properly submitted notices and counter-notices.

3. Submitting a Counter-Notification

If material you posted was removed or disabled because of a DMCA notice and you believe this removal was improper or that you are legally authorized to use the content, you may send a counter-notification to our DMCA Agent. Your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or disabled and the location where the material appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of a mistake or misidentification.
  4. Your name, address, telephone number, and email address.
  5. A statement consenting to the jurisdiction of the federal courts located in the United States and agreeing to accept service of process from the party who originally submitted the DMCA notice.

After receiving a valid counter-notification, SceneAlly may restore the removed material unless the original complainant informs us, within the time required by law, that they have filed a court action to prevent further use of the material.

SceneAlly has no obligation to restore content and may choose not to restore material at its sole discretion.

4. Designated DMCA Agent

All DMCA notices and counter-notices should be sent to SceneAlly’s Designated Copyright Agent at the following email address:

If you prefer, written notices may also be submitted via postal mail to an address you designate for SceneAlly. If you would like SceneAlly to list a mailing address in this Policy, let me know, and I will update this section accordingly.

5. Misuse of the DMCA Process

Submitting false or fraudulent DMCA notices or counter-notices may result in legal liability, including damages, attorney’s fees, and penalties under federal law. Users are strongly encouraged to seek legal advice before submitting a DMCA notice or counter-notification if they are unsure of their rights.

SceneAlly reserves the right to take any action it considers appropriate against anyone who abuses or misuses the DMCA process.
